This Monthly Membership Agreement goes into effect as soon as the Monthly Membership is purchased by the Purchaser and is a legally binding agreement between Jai Bhakti Yoga Foundation and the Purchaser (Member). Membership rights, privileges, and obligations commence on the date of the purchase.

Membership

Any and all membership privileges obtained through this membership agreement may be revoked or changed at any time by Jai Bhakti Yoga Foundation without prior notice to the Purchaser. If the Purchaser wishes to change their membership level, they may change this at any time by canceling their prior monthly membership subscription and purchasing the new membership tier they wish to join. There will be no refunds for months where the Purchaser voluntarily cancels their membership before the end of the billing cycle for that month. The Purchaser is also responsible for all cost increases should they occur during the membership tier change.

Purchaser agrees that they are over 18 (eighteen) years of age and may legally consent to and enter into this Agreement.

Term and Termination

This agreement shall remain in effect until one or more of the following occur:

• Purchaser voluntarily cancels their membership subscription.

• Purchaser does not meet the requirements of the monthly payment requirement.

• Jai Bhakti Yoga Foundation ceases to do business through Monthly Memberships
  

Notices

Jai Bhakti Yoga Foundation is granted the authority to make changes to the membership tiers without notification.

No Warranties or Refunds

No warranties or guarantees are given or implied by this membership agreement. Purchaser agrees that any results that occur during their participation in the Membership services whether positive or negative. are the effects of the Purchaser’s own personal choices.

No Refunds will be given.

Third-Party Services

Certain membership services may integrate, be integrated into, or be provided in connection with third-party websites, services, content, and/or materials (“Third-Party Services”). Jai Bhakti Yoga Foundation does not control any Third-Party Services. Jai Bhakti Yoga Foundation makes no claims or representation regarding the third-party services and accepts no responsibility for, the quality, content, nature, or reliability of Third-Party Services accessible from our website, or any other element of the Membership Service. There is no implied affiliation, endorsement, or adoption by Jai Bhakti Yoga Foundation of these Third-Party Services and we shall not be responsible for any content provided on or through these Third-Party Services. Purchaser should read the terms of use and legal agreements that apply to these Third-Party Services.

Effectiveness and Interpretation of Agreement

Any and all legal proceedings sustained from this agreement shall be set in the jurisdiction of Louisiana. This membership agreement sets forth the entire understanding of the above-mentioned agreement and unless otherwise stated, is not inclusive of any oral or prior written agreements. Any modifications or changes to this agreement must be in written form and signed by both parties.

In case of a dispute between the Parties relating to or arising out of this Agreement, the Parties shall first attempt to resolve the dispute personally and in good faith. If these personal resolution attempts fail, the Parties shall then submit the dispute to binding mediation. The mediation shall be conducted by a single mediator who has no authority to add Parties, vary the provisions of this Agreement, award punitive damages, or certify a class. Purchaser shall pay all of Jai Bhakti Yoga Foundation’s legal fees and costs associated with mediation. Claims necessitating mediation under this section include, but are not limited to: contract claims, tort claims, claims based on federal and state law, and claims based on local laws, ordinances, statutes or regulations. The Parties, in agreement with this sub-part of this Agreement, waive any rights they may have to a jury trial in regard to claims.

Release and Waiver of Liability and Risk

I have read and understand this waiver and have been fully informed of all of Jai Bhakti Yoga Foundation membership terms and conditions as well as membership benefits and limitations. Jai Bhakti Yoga Foundation is not responsible for any injury or loss of property to any person while on the premises or participating in Jai Bhakti Yoga Foundation services or membership activities. As a member, I assume full responsibility for services received at Jai Bhakti Yoga Foundation and shall indemnify Jai Bhakti Yoga Foundation, its affiliates, agents, and employees against any and all liability arising from services rendered or damages, whether tangible or intangible that may happen to Purchaser while participating in the Membership Services.

Purchaser agrees and understands that their participation in the Membership Services may involve risks. These risks may lead to tangible or intangible harm, and Purchaser agrees that these risks may result not only from their own actions by also from the actions of others. With the knowledge and understanding of these risks, Purchaser chooses, of their own will and volition, to continue participating in the Membership Services.
